PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING MANDATORY ARBITRATION AND CLASS ACTION WAIVER PROVISIONS.
By creating an account, accessing, or using ArtHost ("Platform," "Service," "App," "we," "us," "our"), you ("User," "you," "your") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease using the Platform.
1. ACCEPTANCE OF TERMS
By clicking "I Accept," creating an account, or using the Platform, you:
- Acknowledge you have read, understood, and agree to these Terms
- Acknowledge you have read and agree to our Privacy Policy
- Represent you are at least 18 years of age
- Agree to be legally bound by these Terms and any future modifications
- Waive any right to claim you did not read or understand these Terms
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE PLATFORM.
2. NATURE OF SERVICE - CRITICAL DISCLAIMER
2.1 Platform Role
ArtHost is ONLY a technology platform that facilitates connections between users. We are:
- NOT a party to any agreements, contracts, or arrangements between users
- NOT a broker, agent, insurer, or intermediary
- NOT involved in any exchanges, stays, or transactions
- NOT responsible for the actions, conduct, or representations of any user
- NOT a provider of accommodation, artwork, or any other goods or services
2.2 Independent Contractors
All users are independent contractors. No employment, partnership, joint venture, or agency relationship exists between:
- ArtHost and any user
- Users and other users (unless separately agreed)
2.3 No Endorsement
Listing on our Platform does NOT constitute:
- An endorsement, recommendation, or approval by ArtHost
- A guarantee of quality, safety, legality, or authenticity
- Verification of identity, credentials, or representations
- A warranty of any kind
WE DO NOT VET, SCREEN, OR VERIFY USERS, PROPERTIES, OR ARTWORK.
3. COMPREHENSIVE DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."
ArtHost expressly DISCLAIMS all warranties of any kind, whether express, implied, or statutory, including but not limited to:
3.1 Implied Warranties (ALL DISCLAIMED)
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Title
- Quiet enjoyment
- Accuracy
- System integration
3.2 No Warranties Regarding
- User Identity or Background: We make no representations about users' criminal history, character, honesty, or integrity
- Property Safety: We make no representations about building codes, safety standards, habitability, or condition of any property
- Artwork Quality: We make no representations about artwork authenticity, value, quality, or artistic merit
- Transaction Success: We make no guarantee that matches will be successful or satisfactory
- Platform Availability: We do not guarantee uninterrupted, timely, secure, or error-free service
- Data Accuracy: We do not guarantee accuracy, completeness, or reliability of any user-submitted content
- Security: We do not guarantee the Platform is free from viruses, malware, or security vulnerabilities
3.3 Internet and Technology Risks
You acknowledge that use of the Platform involves risks including:
- Transmission delays, failures, or interruptions
- Data corruption or loss
- Unauthorized access to your information
- Technical malfunctions
4. COMPREHENSIVE LIMITATION OF LIABILITY
4.1 No Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTHOST, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, PARTNERS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY "ARTHOST PARTIES") SHALL NOT BE LIABLE FOR ANY:
- Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Personal injury, death, or emotional distress
- Property damage, theft, or loss
- Attorneys' fees or litigation costs
- Any damages arising from or related to:
- Your use or inability to use the Platform
- Interactions with other users (online or in-person)
- Stays at any property listed on the Platform
- Any artwork created, exchanged, or displayed
- Disputes between users
- User content or conduct
- Unauthorized access to your account
- Viruses or malicious code
- Third-party websites or services
- Force majeure events
4.2 Maximum Liability Cap
IF, NOTWITHSTANDING THE FOREGOING, ARTHOST IS FOUND LIABLE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF:
- (a) $100 USD, OR
- (b) The amount you paid in subscription fees to ArtHost in the 12 months preceding the claim
This cap applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
4.3 Essential Basis of Bargain
You acknowledge that these limitations are an essential element of the agreement between you and ArtHost, and that ArtHost would not provide the Platform without these limitations.
5. BROAD RELEASE OF CLAIMS
5.1 General Release
YOU HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE ARTHOST PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, EXPENSES, AND LIABILITIES OF EVERY KIND ARISING FROM OR RELATED TO:
- Your use of the Platform
- Interactions with other users (online or offline)
- Any arrangements, agreements, or exchanges with other users
- Stays at any property
- Quality, authenticity, or value of any artwork
- Property damage, theft, or loss
- Personal injury, illness, or death
- Breaches of contract by other users
- Fraud, misrepresentation, or criminal conduct by other users
- Failure of other users to fulfill agreements
- Disputes over artwork, accommodations, or terms
- Negligence, gross negligence, or willful misconduct of other users
5.2 California Civil Code § 1542 Waiver
IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES:
"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
You understand and acknowledge that you may later discover claims or facts that are different from or in addition to those now known or believed, and you expressly waive any rights under such statutes and comparable laws of any jurisdiction.
6. COMPLETE INDEMNIFICATION
6.1 Your Indemnification Obligations
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ARTHOST PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, COSTS, INVESTIGATIONS, LIABILITIES, JUDGMENTS, FINES, PENALTIES, SETTLEMENTS, INTEREST, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING FROM OR RELATED TO:
- Your use or misuse of the Platform
- Your breach of these Terms
- Your violation of any law, regulation, or third-party right
- Your content, including any claims of infringement or misappropriation
- Your interactions or arrangements with other users
- Any stays at properties you list or visit
- Any artwork you create, exchange, or display
- Property damage you cause
- Personal injury or death you cause or contribute to
- Your fraud, misrepresentation, or illegal conduct
- Your negligence or willful misconduct
- Claims brought by other users against you
- Any third-party claims arising from your use of the Platform
6.2 Defense Rights
ArtHost reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate fully with ArtHost in the defense of any claim.
7. MANDATORY USER RESPONSIBILITIES
7.1 Your Sole Responsibility
YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY AND COMPLETELY RESPONSIBLE FOR:
Safety & Due Diligence
- Conducting comprehensive background checks on all users you interact with
- Verifying identity through government-issued ID and multiple independent sources
- Checking criminal records, sex offender registries, and court records
- Contacting references and reviewing all available reviews
- Conducting video calls before any in-person meetings
- Trusting your instincts and declining arrangements that feel unsafe
- Informing trusted friends/family of your location and plans
- Having emergency contacts and exit strategies
Legal Compliance
- Complying with all federal, state, local, and international laws
- Obtaining all necessary permits, licenses, and approvals
- Ensuring compliance with zoning, housing, and rental regulations
- Complying with tax laws and reporting obligations
- Creating and executing legally binding contracts
- Consulting with attorneys regarding all legal matters
- Resolving all disputes directly with other users
Insurance
- Obtaining comprehensive insurance coverage, including:
- Homeowners or renters insurance with adequate liability coverage
- Guest or short-term rental insurance (for hosts)
- Travel insurance (for artists)
- Health insurance
- Professional liability insurance
- Personal property insurance
- Umbrella liability policies
- Ensuring insurance covers the specific activities and risks involved
- Reviewing policy exclusions and limitations
- Maintaining continuous coverage
Property & Safety
- Ensuring properties meet all building codes and safety standards
- Maintaining smoke detectors, carbon monoxide detectors, fire extinguishers
- Ensuring adequate security (locks, lighting, etc.)
- Disclosing all hazards, risks, and material defects
- Providing safe working conditions and proper ventilation
- Ensuring proper disposal of art materials and hazardous waste
- Protecting against environmental hazards
Health Matters
- Disclosing all relevant health conditions, allergies, or limitations
- Ensuring adequate health insurance and emergency medical access
- Managing medications and medical equipment
- Addressing any disabilities or accessibility needs
- Protecting against infectious diseases
Documentation
- Creating detailed written agreements covering all terms
- Documenting property condition before and after stays (photos, videos, written reports)
- Maintaining records of all communications
- Obtaining signatures on all contracts
- Keeping copies of insurance policies, permits, and licenses
7.2 Prohibited Reliance
YOU AGREE THAT YOU WILL NOT RELY ON:
- Profile information without independent verification
- Reviews or ratings as a substitute for due diligence
- Platform features as safety or security measures
- Any representations by ArtHost regarding user safety or reliability
8. STRICTLY PROHIBITED CONDUCT
8.1 Zero Tolerance Activities
THE FOLLOWING ARE STRICTLY PROHIBITED AND WILL RESULT IN IMMEDIATE ACCOUNT TERMINATION AND POTENTIAL LEGAL ACTION:
Criminal Activity
- Any illegal activity whatsoever
- Drug manufacture, distribution, or use (except lawfully prescribed medications)
- Weapons violations
- Human trafficking or modern slavery
- Money laundering or financial crimes
- Fraud, embezzlement, or theft
- Assault, battery, or violence of any kind
- Stalking or harassment
- Terrorism or terrorist-related activities
- Child endangerment or exploitation (ANY content involving minors in inappropriate contexts)
Platform Misuse
- Using the Platform for romantic, dating, or sexual purposes
- Sexual services, solicitation, or prostitution
- Commercial activities not expressly permitted
- Spam, phishing, or deceptive practices
- Intellectual property infringement
- Impersonation or identity fraud
- Creating multiple accounts to evade bans
- Automated access (bots, scrapers, etc.) without permission
- Circumventing security measures
- Reverse engineering or attempting to access source code
Discriminatory Conduct
- Discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics (except where legally permitted, such as gender preferences for shared housing)
- Hate speech or promotion of violence
- Harassment or bullying
Safety Violations
- Providing false information about identity, credentials, or property
- Failing to disclose material health or safety risks
- Creating unsafe conditions
- Failing to maintain adequate insurance
8.2 Consequences
Violation of these prohibitions may result in:
- Immediate account termination without refund
- Reporting to law enforcement
- Civil legal action
- Criminal prosecution
- Permanent ban from the Platform
- Liability for all damages caused
9. NO VERIFICATION OR BACKGROUND CHECKS
9.1 What We Do NOT Do
ARTHOST DOES NOT AND WILL NOT:
- Conduct criminal background checks
- Verify identity documents
- Confirm professional credentials or portfolios
- Authenticate artwork or claimed value
- Inspect properties or verify conditions
- Confirm insurance coverage
- Verify compliance with laws or regulations
- Monitor communications between users
- Supervise stays or exchanges
- Investigate disputes
- Verify age beyond account creation requirements
9.2 Profile Verification
Any "verified" badges or indicators:
- Are based SOLELY on user-submitted information
- Do NOT constitute verification by ArtHost
- Should NOT be relied upon as confirmation of identity, safety, or legitimacy
- Are for convenience only and provide NO assurance
9.3 Your Duty to Verify
IT IS YOUR SOLE RESPONSIBILITY to verify everything about other users through independent means.
10. CONTENT & INTELLECTUAL PROPERTY
10.1 User Content License
By posting content, you grant ArtHost:
- A worldwide, non-exclusive, royalty-free, transferable, sublicensable license
- To use, reproduce, modify, adapt, publish, translate, create derivative works, distribute, perform, and display your content
- In any media formats and through any channels (including for marketing purposes)
- This license continues even after account termination for content that has been shared with other users
10.2 Content Responsibility
You represent and warrant that:
- You own or have rights to all content you post
- Your content does not violate any third-party rights
- Your content complies with all applicable laws
- Your content is accurate and not misleading
10.3 Artwork Rights
ArtHost has no involvement in artwork ownership or intellectual property disputes. Artists and hosts must:
- Agree in writing to all terms regarding artwork ownership
- Clarify copyright retention or transfer
- Address reproduction rights, display rights, and derivative works
- Resolve all intellectual property disputes privately
11. PRIVACY & DATA PROTECTION
11.1 Data Collection & Use
By using the Platform:
- You consent to data collection and use as described in our Privacy Policy
- You acknowledge communications may not be encrypted or private
- You agree we may share data with service providers, law enforcement, or as required by law
- You understand we cannot guarantee data security
11.2 Third-Party Services
The Platform may integrate with third-party services (payment processors, map providers, etc.). Your use of these services is governed by their terms and privacy policies.
11.3 International Users
If you access the Platform from outside the United States:
- You consent to transfer and processing of your data in the United States
- You are responsible for compliance with local laws
- Additional privacy protections may apply (e.g., GDPR for EU users - see Privacy Policy)
12. PAYMENT TERMS
12.1 Subscription Fees
- Annual subscription: $200 USD (subject to change with 30 days notice)
- Payment required before full Platform access
- All fees are non-refundable under any circumstances
- We reserve the right to change pricing at any time
12.2 No Refunds Policy
ALL FEES ARE FINAL AND NON-REFUNDABLE, INCLUDING IF:
- You don't find suitable matches
- You're dissatisfied with the Platform
- Your account is terminated
- You violate these Terms
- You change your mind
- The Platform is unavailable
- You experience technical difficulties
We may, at our sole discretion, extend your subscription if you do not make connections, but this is not guaranteed.
12.3 Third-Party Payment Processor
Payments are processed by third-party providers (e.g., Stripe). You must comply with their terms. ArtHost is not responsible for payment processor errors, failures, or security.
12.4 Transactions Between Users
ArtHost does NOT:
- Process payments between artists and hosts
- Guarantee payment or exchanges will occur
- Mediate financial disputes
- Take any percentage of exchanges or transactions
All financial arrangements between users are solely their responsibility.
13. INTELLECTUAL PROPERTY PROTECTION
13.1 ArtHost Ownership
All Platform content, features, functionality, software, code, design, graphics, logos, trademarks, and service marks are owned by ArtHost and protected by copyright, trademark, patent, and other intellectual property laws.
13.2 Restrictions
You may NOT:
- Copy, modify, distribute, sell, or lease any part of the Platform
- Reverse engineer or attempt to extract source code
- Create derivative works
- Use our trademarks or branding without written permission
- Frame or mirror any Platform content
- Use automated systems to access the Platform
13.3 DMCA Compliance
We comply with the Digital Millennium Copyright Act. To report copyright infringement, contact: [YOUR DMCA EMAIL]
14. ACCOUNT TERMS
14.1 Eligibility
You must:
- Be at least 18 years of age
- Have legal capacity to enter binding contracts
- Not be prohibited from using the Platform under applicable law
- Provide accurate and complete registration information
14.2 Account Security
You are responsible for:
- Maintaining confidentiality of your password
- All activity under your account
- Notifying us immediately of unauthorized access
- Ensuring your contact information is current
14.3 Account Termination
We may terminate or suspend your account at any time, with or without notice, for any reason or no reason, including:
- Violation of these Terms
- Suspected illegal activity
- Complaints from other users
- Inactivity
- At our sole discretion
You may terminate your account at any time, but no refunds will be provided.
Upon termination:
- Your right to use the Platform immediately ceases
- We may delete your content and data
- Sections of these Terms that should survive (indemnification, liability limitations, etc.) remain in effect
15. DISPUTE RESOLUTION & ARBITRATION
15.1 Mandatory Arbitration
YOU AGREE THAT ALL DISPUTES WITH ARTHOST (NOT WITH OTHER USERS) SHALL BE RESOLVED BY BINDING ARBITRATION, AND YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
This includes disputes arising from or relating to:
- These Terms
- Your use of the Platform
- Any services provided by ArtHost
- Any representations made by ArtHost
- Privacy or data practices
- Account termination
15.2 Arbitration Procedures
- Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
- Arbitration shall take place in [YOUR COUNTY, STATE]
- Each party pays their own costs and attorneys' fees unless the arbitrator awards otherwise
- The arbitrator's decision is final and binding
- Judgment on the award may be entered in any court with jurisdiction
15.3 Exceptions to Arbitration
Either party may seek injunctive relief in court to:
- Prevent infringement of intellectual property rights
- Prevent unauthorized access to the Platform
- Enforce these Terms
15.4 Class Action Waiver
YOU AGREE THAT DISPUTES MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
The arbitrator may not:
- Consolidate claims without consent of all parties
- Preside over any class, collective, or representative proceeding
- Award relief to anyone other than you individually
15.5 Disputes Between Users
ArtHost is NOT involved in disputes between users.You must resolve all disputes with other users directly. This includes:
- Breach of contract
- Property damage
- Personal injury
- Artwork disputes
- Payment disputes
- Any other disagreements
We strongly recommend:
- Having detailed written contracts
- Obtaining mediation or arbitration through private services
- Consulting legal counsel
- Pursuing legal action in appropriate courts
ArtHost WILL NOT mediate, arbitrate, testify, provide evidence, or participate in any disputes between users.
16. FORCE MAJEURE
ArtHost is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
- Acts of God (earthquakes, floods, fires, storms, pandemics)
- War, terrorism, riots, civil unrest
- Government actions or restrictions
- Internet or telecommunications failures
- Power outages
- Labor disputes
- Supplier failures
17. MODIFICATIONS TO TERMS
17.1 Right to Modify
We reserve the right to modify these Terms at any time. Changes become effective:
- Upon posting to the Platform, OR
- As specified in the updated Terms
17.2 Notice of Changes
We will provide notice of material changes by:
- Posting on the Platform
- Email to your registered address
- In-app notification
17.3 Acceptance of Changes
Continued use of the Platform after changes constitutes acceptance of modified Terms. If you don't agree to changes, you must stop using the Platform (no refund provided).
18. GENERAL PROVISIONS
18.1 Governing Law
These Terms are governed by the laws of the State of [YOUR STATE], United States, without regard to conflict of law principles.
18.2 Venue
Subject to the arbitration provisions, any legal action must be brought exclusively in federal or state courts located in [YOUR COUNTY, STATE], and you consent to personal jurisdiction there.

18.5 Assignment
You may not assign or transfer these Terms or your account. ArtHost may assign these Terms without restriction.
18.6 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and ArtHost.
18.7 Survival
Provisions that by their nature should survive termination (including indemnification, liability limitations, dispute resolution, and intellectual property provisions) shall survive.
18.8 Headings
Section headings are for convenience only and do not affect interpretation.
18.9 Language
In the event of translation, the English version controls.

20. APP STORE TERMS
20.1 App Store Compliance
If you access the Platform through an app downloaded from an app store (Apple App Store, Google Play, etc.):
- These Terms are between you and ArtHost only, not the app store provider
- The app store provider has no obligation to provide maintenance or support
- The app store provider is not responsible for the Platform or any claims related to it
- You represent you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
- You represent you are not on any U.S. Government prohibited or restricted parties list
20.2 Apple App Store Additional Terms
If downloaded from Apple App Store:
- You acknowledge Apple has no obligation to provide maintenance or support
- In the event of failure to conform to any warranty, you may notify Apple for a refund (if applicable), and Apple has no other warranty obligation
- Apple is not responsible for addressing any claims by you or third parties
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them
- You must comply with any applicable third-party terms when using the Platform
20.3 Google Play Additional Terms
If downloaded from Google Play:
- You must comply with Google Play's Terms of Service
- Google is not responsible for the Platform or any claims related to it
21. FINAL ACKNOWLEDGMENTS
BY USING ARTHOST, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- You have carefully read and fully understand these Terms
- You accept all risks associated with using the Platform
- You are solely responsible for your safety, property, and well-being
- You will conduct comprehensive due diligence on all users you interact with
- You will create detailed written contracts for all arrangements
- You will obtain appropriate insurance coverage
- You release ArtHost from all liability
- You will indemnify ArtHost for any claims arising from your use
- You waive the right to a jury trial and class actions
- All fees are non-refundable
- ArtHost is a listing platform only and not a party to your arrangements
- ArtHost does not verify users, properties, or artwork
- You are at least 18 years old
- You will comply with all applicable laws
- You understand that user interactions carry significant risks
22. SPECIFIC RISK ACKNOWLEDGMENTS
22.1 Safety Risks
You acknowledge and accept risks including but not limited to:
- Physical harm, injury, or death
- Assault, theft, or criminal activity
- Property damage or loss
- Exposure to infectious diseases
- Unsafe property conditions
- Fire, structural failure, or natural disasters
- Inadequate security or emergency access
- Toxic fumes or hazardous materials from art supplies
22.2 Financial Risks
You acknowledge and accept risks including:
- Receiving artwork of less value than expected
- Not receiving promised artwork
- Property damage exceeding insurance coverage
- Loss of income or business opportunities
- Legal costs and damages from disputes
- Tax liabilities from exchanges
22.3 Legal Risks
You acknowledge and accept risks including:
- Violations of rental, zoning, or housing laws
- Violations of tax laws
- Breach of contract by other users
- Intellectual property disputes
- Liability for injury or damage to third parties
- Insurance coverage disputes or denials
22.4 Reputational Risks
You acknowledge and accept risks including:
- Negative reviews or ratings
- Public disputes with other users
- Social media exposure
- Damage to professional reputation
ACCEPTANCE
BY CLICKING "I ACCEPT," CREATING AN ACCOUNT, OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
